Extension of CrPC, CPC shouldn’t affect powers of district council: KHADC to govt

The Khasi Hills Autonomous District Council (KHADC) has urged the government to ensure that the extension of the Code of Criminal Procedure (CrPC) and Code of Civil Procedure (CPC) does not affect the powers of the District Councils.

“We have decided to send a resolution to the state government in this regard and urge the notification should not affect the existing powers and the authority of the District Councils,” said Titos Chyne, chief executive member (CEM) of the council after an all-members of district council (MDC) meeting, on Monday.

He added that it all depends on the state government’s wisdom to extend the CrPC and CPC and said, “We are firm that whatever the district council courts have practised all these years will remain.”

They discussed the impact of extending the CrPC and CPC in the state. The Commissioner and Secretary of District Council Affairs (DCA) held a meeting on Friday with the three Autonomous District Councils (ADCs) in Garo, Jaintia and Khasi Hills in which legal counsels of the KHADC were present.

The state government has decided to re-look into the proposal to extend CrPC and CPC in the entire state and to prepare a draft notification on the subject which will be sent to the Councils to seek their views.

“We are waiting for the draft from the government where we will discuss with the EC and our legal counsels,” Chyne said.

Chyne raised a concern that with the implementation of CrPC and CPC, the district session court in the districts will be able to try cases if both parties are tribals.

He went on to explain that it will affect the public as there are cases that are tried only at the level of the village court and those that are tried at the level of the additional subordinate, which means village courts or the Hima Courts.

The CEM stressed that whatever the Council Courts have been practising all these years should remain.

According to Chyne, if the CrPC and CPC is implemented, the power of the judiciary in the KHADC is diluted.

The MDCs also discussed and came to the conclusion that they will oppose the implementation of the Limitation Act in the state and will take up the matter with the government as well.
