Engineer, contractor convicted in graft cases in Mizoram

Both were convicted in graft cases under Prevention of Corruption Act and sentenced to 2 years of rigorous imprisonment each.

AIZAWL:

An engineer working under Mizoram Power and Electricity department and a supplier/contractor were convicted in graft cases by Special Judge (Prevention of Corruption Act), on June 24.

Laldawngliana, an engineer working under Mizoram Power and Electricity department, and Swopan Kumar Roy, the contractor, were convicted in graft cases under Prevention of Corruption Act and sentenced to 2 years of rigorous imprisonment each.

The special judge Vanlalenmawia found Laldawngliana, resident of Ramhlun North, Aizawl and now holding the post of Executive Engineer in the Power department, guilty in the corruption cases against him and convicted him under sections 44/120B/420/409/477A of the Indian Penal Code (IPC) and Sections 13 (1)(c)(d) read with 13 (2) of the Prevention of Corruption Act, 1988.

Laldawngliana was sentenced to undergo Rigorous Imprisonment (RI) for 2 years, and as per the sentence he was convicted for 2 years under sections 120B/420 IPC, 2 years u/s 120B/409 IPC, 2 years u/s 477A IPC and 2 years u/s 13(1)(c)(d) r/w 13 (2) of Prevention of Corruption Act, 1988. The sentence, however, would run concurrently, meaning he would be imprisoned for 2 years.

He has also been directed to pay a fine of Rs 3,63,000, failing which he would have to serve another prison sentence of 90 days.

Swopan Kumar Roy, husband of late Rinpuii, proprietor of Aizawl-based RP Processing unit was sentenced to undergo Rigorous Imprisonment (RI) for 2 years under Section 120B/420 IPC and 1 year u/s 403 IPC. In this case also, Roy’s sentence will run concurrently, and he has been asked to pay a fine of Rs 3,63,000 – in default of another simple imprisonment (SI) for 90 days.

Laldawngliana, who was then posted as SDO at the Kau electrical Sub Division and other Power and Electricity department, and two other senior officials, C Liansanga (former Chief Engineer) and Lalnunmawia Sailo (then Superintending Engineer), were indicted by the state Anti Corruption Bureau (ACB).

Sailo was acquitted by the Special Court due to lack of evidence as put forward by the prosecution, while Liansanga’s case was still pending in the same court.
