HSPDP against CPC, CrPC in 6th Schedule areas

Senior vice-president of the HSPDP, Martle Mukhim, said that the proposal of the state government to notify the CPC and the CrPC will affect the autonomous areas of the state.

The Hill State People’s Democratic Party (HSPDP) on September 6 said that it is opposed to the plan of the government to notify the Civil Procedure Code and Criminal Procedure Code in the Sixth Schedule areas.

Senior vice-president of the HSPDP, Martle Mukhim, said that the proposal of the state government to notify the CPC and the CrPC will affect the autonomous areas of the state.

Mukhim said that as enshrined in the Constitution of India in Article 244 Para 4 and 5 the judicial power has been given to the autonomous district councils.

“This means the district councils can make laws on judiciary,” Mukhim said.

The Member of District Council who is also the Executive Member (EM) in the Khasi Hills Autonomous District Council (KHADC) said that even with the notification on many occasions the state government has been encroaching into the autonomous district council’s jurisdiction.

He also said that the government is trying out ways and means how to weaken the power and authority of the district councils.
